- Purpose and legal basis for the collection and processing of personal data
3.a. Purpose
Conducting a procurement procedure “RMA and AMA Learning Management System”
3.b. Legal basis
Art. 6 (1) lit. c) in conjunction with Art. 6 (3) GDPR and sections 97 (1) sentence 1, 122 ARC
- Collection of personal data by third parties
Pursuant to section 19 subsection 4 MiLoG, section 21 subsection 4 AEntG, section 21 sub- section 1 sentence 5 SchwarzArbG, section 98c subsection 3 AufenthG in conjunction with section 21 (4) AEntG and section 22 LkSG, the contracting entity is obliged to request infor- mation from the competition register pursuant to section 6 Competition Register Act (Wettbew- erbsregistergesetz – WRegG) on the absence of the respective grounds for exclusion before awarding the contract to the tenderer who is to be awarded the contract.
- Criteria for determining the duration of the retention of personal data
The duration of the storage of personal data follows the retention periods under public pro- curement law (section 8 (4) VgV).
- The Rights of the Data Subjects
Right to Information
There is a right of access to the personal data processed by the registry (Art. 15 GDPR).
Right to Rectification
There is a right to rectification where the information concerning the candidate or tenderer is not (no longer) accurate. Incomplete data can be completed (Art. 16 GDPR).
Right to Deletion
In principle, there is a right to deletion of personal data. However, the entitlement depends, among other things, on whether the data are still needed to fulfil the tasks (see also duration of storage) (Art. 17 GDPR).
Right to Limit the Processing
There is a right to demand that the processing of the applicant's/tenderer's data be restricted (Art. 18 GDPR).

Right to Appeal
The right exists to object to the processing of the data relating to the applicant or tenderer for reasons arising from the particular situation of the latter unless this is contrary to an overriding public interest or a legal provision (Art. 21 GDPR).
