I/we hereby offer to perform the service(s) described in the tender documents at the inserted prices.

I/we shall remain bound to this offer until the expiry of the adjudication and commitment period stated in the call for tender.

If the price offer should prove inadmissible following an examination in line with the Ordinance PR No. 30/53, the price allowable under price law shall apply to any contract.

1. Scope of supply and performance

The tender documents provided for the above-mentioned process (application and contract terms) as well as other conditions specified in the call for tenders shall form the basis for the offer.

These apply to contracts with a value of EUR 50,000 or more for services provided in Germany.

1. Fee/Price

All the missing information in the following table should be filled in by the bidder.

Prices quotations should be entered in all fields overwritten or tagged with “unit price” or “total price”. If quotations in the total price fields turn out to be incorrect following a calculatory check of the offer or if these have been omitted, only the quotations in the unit price fields shall apply.

If key quotations are missing, according to Section 56 (3) VgV these cannot be requested again, meaning the offer will have to be excluded.

I/we offer to fulfil the contract and render the described services at the prices I/we have set. Prices are quoted in EURO excluding VAT.

For the option, the order shall only be placed if the customer requests the execution of this item in writing within 12 months of the contract being awarded.

1. MRI

The client shall provide multi-risk insurance in accordance with Appendix [B160]. The client is entitled to pass on the costs of the insurance to the contractor in the amount of 0.8% of the net final invoice amount and to retain a corresponding share from the contractor's respective partial invoices until the final payment. The contractor shall list the item in the respective invoices in accordance with the above and deduct it from the invoice amount.

Liability is limited to intent and gross negligence for fault-based liability. Liability for lost profits is excluded. Contractual warranty for defects is not affected by the exclusions of liability. Any exclusion of liability shall only apply if there is no insurance coverage.

1. Payment Terms

Billing and payments will take place in EURO. Payments will not be made until the payment conditions have been met and the respective invoice has been received. If advance payments are provided for contractually, these can only be made upon presentation of an unlimited bank guarantee - free of charge for the Client - and following the issue of an invoice.

1. Customs tariff number

The tenderer must specify separately all relevant customs tariff numbers of the goods which are to be offered. If these are not yet available, he must instead inform the contracting authority of the offer. The awarding authority reserves the right to demand the customs tariff numbers once. However, there is no entitlement of the bidder to this. The tenderer may be excluded from the procedure if the customs tariff numbers are not renamed.

1. Contractor's duty to provide information regarding CBAM (applies only to non-EU countries)

If the client has obligations under Regulation (EU) 2023/956 (Carbon Border Adjustment Mechanism – CBAM), as amended, in connection with the contractual deliveries, the contractor is obliged to provide the client with the information and evidence necessary to fulfil these obligations without being asked and in a timely manner.

The obligation under paragraph 1 shall only arise if the client is considered an importer within the meaning of the Regulation.

The information to be provided shall include, in particular:

• • Customs tariff number (CN code),
  • Country of origin,
  • Manufacturer details,
  • Direct and, where relevant, indirect greenhouse gas emissions in accordance with EU regulations,
  • calculation methodology used,
  • evidence of CO₂ prices paid in the country of origin.

The information must be provided at the latest upon delivery.

The contractor shall ensure the accuracy and completeness of the information and shall inform the client immediately of any changes relevant to CBAM obligations.

If the contractor culpably fails to fulfil its obligations under paragraphs 1 to 5, either in whole or in part, or fails to do so in a timely manner, the client shall be entitled to demand a contractual penalty. This shall amount to 0.1% of the order value for each calendar day or part thereof in which the obligation is breached, but shall not exceed a total of 5% of the order value.

The assertion of further damages remains unaffected; any contractual penalty forfeited shall be offset against any claims for damages.

An exhaustive list of the documents to be submitted with the offer can be found in the conditions of application under Item, Components of the offer.

The declarations included in this list are enclosed with my/our offer.

I agree/ we agree that the personal data I / we provided will be processed and stored for the tendering process and that, in the case of EU tenders, according to Section 134 GWB the name of the successful bidders and, under certain circumstances according to Section 62 VgV, the characteristics and advantages of its offer will be disclosed to the unsuccessful bidders.

I/we acknowledge that knowingly providing false information can lead to exclusion from this and other invitations to tender.
