| 1 | We have a question regarding the FEED, if there is any incompatibility of being the FEED contractor and further on, being the EPC contractor if the project reaches the FID. | Dear Sir or Madam, Thank you for your question submitted in the context of the current FEED tender procedure. We appreciate your interest in obtaining an early clarification regarding the possibility of participating in any subsequent EPC tender procedure. As a general matter, we would like to point out that the performance of the FEED contract does not automatically result in the contractor being excluded from a subsequent EPC procurement procedure. Should the EPC services be procured through a formal tender procedure, Uniper will provide for appropriate measures to ensure equal treatment of all market participants and fair competition, as well as to neutralise any competitive advantages arising from prior involvement. In doing so, Uniper will follow the applicable procurement law requirements and the principles established by the relevant case law. In particular, it is envisaged that any information and findings generated during the FEED phase that are relevant to the subsequent EPC tender procedure will be made available to all interested tenderers in a transparent and non-discriminatory manner. In addition, appropriate organisational measures will be implemented to ensure that the tender documents are prepared in an objective and competition-neutral manner. Against this background, Uniper currently assumes that, within the framework of a formal EPC tender procedure, any competitive advantages arising from the FEED phase can be effectively mitigated through appropriate measures. According to our current assessment, there is, in principle, no impediment to the FEED contractor participating in any subsequent EPC tender procedure. With regard to a formal procurement procedure, Uniper will take into account the measures required under applicable procurement law in order to ensure fair and non-discriminatory competition.
