Question 1)
Can the minimum eligibility requirement under section 2.3 n) B be fulfilled through a suitability lender/subcontractor in accordance with section 2.3.1, provided that the applicant itself fulfils requirement F through its own references under section 2.3 n)?
Answer to Queston 1)
The Party (e.g. suitability lender) who is giving the reference with regard to the requirements of 2.3 n) B. needs to fulfil itself the obligations under 2.3 n) F with regard to the minimum value respectively percentage set in 2.3 n) F.
Question 2)
Regarding subcontractors providing capacity lending, could you please clarify whether a subcontractor whose capacities are relied upon solely for technical and/or professional qualification is required to submit a turnover declaration (Form V)? In particular, please clarify whether Form V is required in cases where the subcontractor provides technical and/or professional capacities but does not provide economic and/or financial capacity.
Answer to Queston 2)
The eligibility form call for tender number V is not required for subcontractors providing capacity lending. However, the candidate is additionally required to submit Forms II, III, VI and VII with regard to the information of the subcontractor's company. In addition, the applicant is required to submit a declaration of commitment from the subcontractor using Form X.
